ACCEPTANCE OF TERMS OF USE
Lien Sale Locator is a service, including but not limited to liensalelocator.com (the "Website") and software applications downloadable therein (the "Applications"). You must be of legal age to enter into a binding agreement in order to accept the Terms. If you do not agree to the General Terms, do not use any of our Services. 

Please read these Terms carefully before using the Services. By accessing the Application or using the Services, you agree to be bound by these Terms of Use and all terms, policies and guidelines incorporated by reference in these Terms. If you do not agree with these Terms in their entirety, you may not use the Services.

Lien Sale Locator reserves the right to limit or terminate your access to the Applications if you do not comply with these Terms of Use. Lien Sale Locator reserves the right, at its sole discretion, to change, modify, update, add, or remove portions of the Terms of Use at any time, with or without notice to you.   

By becoming a registered user you agree to provide (i) true, accurate, current and complete information about yourself as prompted by the registration form, and (ii) maintain and properly update your account information to keep it true, accurate, current and complete. If you provide information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that you have, or you violate these Terms, as determined in our sole discretion, we have the right to suspend or terminate your Registration and refuse any and all current or future use of the Site and the Service (or any portion thereof).

FEE-BASED SERVICE CHARGES: 
Certain features of this Site are available only through the purchase of a site subscription (Fee- Based Services). If you choose to use the Fee-Based Service, you agree to pay, using a valid credit card, a monthly subscription charge set forth on the Site and other charges incurred on your account in order to access the Fee-Based Services.  

After the trial period of 30 days, you will be billed every month thereafter until you cancel. The subscription fee will be automatically billed to the credit card you provided and authorized at the time of registration. The renewal charge will be the then-current published rate for the term of your subscription. In the event LienSaleLocator.com cannot charge your account, we reserve the right, in our sole discretion, to continue trying to bill your account or to terminate your access to the Fee-Based Services. 

PRICING INFORMATION 
Monthly Subscription: 
You will have full access to the service for 30 days. Cancel at anytime, otherwise, you will be billed $100.00 exactly 30 days, on the hour, from the date and time you originally registered. YOUR ACCOUNT WILL THEREAFTER CONTINUE TO BE BILLED ON A MONTHLY BASIS UNTIL CANCELED.

At its sole discretion, Lien Sale Locator may offer different subscription terms on its Site and the Subscription fees for such subscriptions may vary from time to time. 

SUBSCRIPTION: 
You will have full access to the service for 30 days during the $49.99 trial period. Cancel at any time, otherwise, you will be billed $100.00 exactly 30 days, on the hour, from the date and time you originally registered. YOUR ACCOUNT WILL THEREAFTER CONTINUE TO BE BILLED ON A MONTHLY BASIS UNTIL CANCELED. 

CANCELLATION AND REFUND POLICY:
You understand that to cancel your subscription, you must do so in your user profile. There are no refunds for any subscriptions.   

GENERAL:
These Terms constitute the entire understanding and agreement between you and Lien Sale Locator with respect to the Site and, if applicable, the Fee- Based Services and supersedes all prior agreements between you and Lien Sale Locator. Failure by Lien Sale Locator to enforce any provision of these Terms shall not be construed as a waiver of any provision or right. 

 In the event that any portion of these Terms are held unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of the provisions shall remain in full force and effect. If you do not wish to be bound by these Terms, you should not visit or use the Site. Lien Sale Locator reserves the right to change these Terms from time to time at its sole discretion, without prior notice.

COPYRIGHT AND TRADEMARKS:
All materials on the Site, including without limitation text, images, software, databases, and Fee- Based Services (collectively, the content) are owned or controlled by Lien Sale Locator, its content suppliers and/or other content providers and is protected by the copyright and trademark laws of the United States and other countries, international conventions, and other applicable laws.

Except as otherwise permitted on the Site, you may not download, display, reproduce, create derivative works from, transmit, sell, distribute, or in any way exploit the Site or any portion thereof for any public or commercial use without the prior written permission of Lien Sale Locator.  

NO UNLAWFUL OR PROHIBITED USE/ INTELLECTUAL PROPERTY:
You are granted a non-exclusive, non-transferable, revocable license to access and use Lien Sale Locator strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to Lien Sale Locator that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Lien Sale Locator.   

INFORMATION PROVIDED: 
You acknowledge that any reliance upon any advice, opinion, statement, or other information displayed, made available, or otherwise distributed through the Site is at your sole risk. The information on this Site is provided solely for informational purposes and does not constitute an offer to sell or rent vehicles. 

Information on this Site is deemed reliable, but not guaranteed and should be independently verified. Lien Sale Locator reserves the right, in its sole discretion and without notice, to correct any errors or omissions in any portion of the Site, or to deny access to the Site to anyone at any time. 

AGE RESTRICTIONS: 
You represent and warrant to Lien Sale Locator that you are at least eighteen (18) years old and that you possess the legal right and ability to enter into this Agreement and to use the Site (and Fee Based Service, if applicable) in accordance with this Agreement.    

FINANCIAL RESPONSIBILITY:
You agree not to assign, transfer or sublicense your rights as a subscriber to the Fee-Based Services. You agree to be financially responsible for all usage or activity on your Fee-Based Services account, including, without limitation, authorizing any other person or entity to utilize your account. 

ELECTRONIC COMMUNICATIONS:
You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.  

TERMINATION/ACCESS RESTRICTION:
Lien Sale Locator reserves the right, in its sole discretion, to terminate your access to the Site and the related Application services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of California and you hereby consent to the exclusive jurisdiction and venue of courts in California in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section. 

LIABILITY DISCLAIMER:
The information, application and services included in or available through the site may include inaccuracies or typographical errors. Changes are periodically added to the information herein. Lien Sale Locator may make improvements and/or changes in the site at any time. To the maximum extent permitted by applicable law, in no event shall Lien Sale Locator be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the application and website with the delay or inability to use the site or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the site, or otherwise arising out of the use of the site, whether based on contract, tort, negligence, strict liability or otherwise, even if Lien Sale Locator has been advised of the possibility of damages. 

Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. If you are dissatisfied with any portion of the site, or with any of these terms of use, your sole and exclusive remedy is to discontinue using the site.
